Bull Shoals Councilman Arrested for Tresspassing

A member of the Bull Shoals City Council has been arrested for allegedly trespassing.

Seventy-year-old Kirby L. Davenport has been released from the Marion County Sheriff’s Department on his own recognizance.

According to the probable cause affidavit, the victim called a complaint into the sheriff’s office Dec. 21 of last year stating ever since he purchased property in Bull Shoals, he has had issues with someone trespassing. The victim stated he noticed tire tracks from a vehicle and ATV tracks on the property on several occasions.

The victim stated he placed multiple ‘No trespassing’ signs as well as a trail camera but when visiting the property at a later date, he noticed a fallen tree had been cut up and hauled off. After checking the trail camera, the victim determined the trespasser was an older white male in a side by side as well as another truck coming and going from the property.

The victim took pictures from the trail camera to show neighbors who positively identified Davenport as the trespasser.

Authorities state multiple trips have been made to Davenport’s residence to make contact but each time, Davenport would not answer the door.

The victim launched another complaint against Davenport stating Davenport allegedly desires the property to be annexed by the City of Bull Shoals for what is believed to be for no other reason than to ‘get back’ at the victim.

Davenport has been charged with misdemeanor counts of criminal trespassing and criminal mischief in the first degree.
